Probation Period in Azerbaijan 2026: Maximum Length, Exemptions and Termination Rules
05 Nov 2026 Sənan Süleymanlı

Short answer: Under the Azerbaijan Labour Code, a probation period can only be agreed by both parties when the employment contract is signed. It may last up to two weeks for contracts of up to six months and up to three months for all other contracts (Article 51). Sick leave and other excused absences during which the job and average pay are kept do not count towards it. Until probation ends, either side can terminate the contract with three days' written notice (Article 53). An employee who fails probation is not entitled to severance pay, but unused annual leave must still be paid out.

What probation is and how long it can last

Probation exists to test the employee's professional level and ability to perform the specific job (Article 51.1). It cannot be imposed by one side: a probation period applies only if employer and employee agree on it in the contract. Law No. 1017-VIQD of 24 October 2023 rewrote Article 51.1 and introduced two caps depending on the length of the contract:

Length of employment contractMaximum probationBasis
Up to two monthsNo probation allowedArticle 52
Two to six monthsTwo weeksArticle 51.1
More than six months or open-endedThree monthsArticle 51.1

These are ceilings: the parties may agree on a shorter period, such as one month. A clause providing for more than three months conflicts with the Code and, because it worsens the employee's position, is risky to rely on in a dispute.

Who cannot be put on probation

Under Article 52, no probation period is set when concluding a contract with:

  • persons under 18;
  • persons appointed through a competition;
  • pregnant women, women with a child under three, and men raising a child under three alone;
  • graduates hired for the first time in their field in the year they complete their studies;
  • persons elected to a paid elected office;
  • persons hired under a contract of up to two months;
  • other cases agreed by the parties.

If a probation clause is nevertheless written into such an employee's contract, a dismissal for "failing probation" based on it is likely to be challenged as unlawful. Employers should therefore check age, pregnancy, the child's age and graduation year at the hiring stage.

Writing probation into the contract and e-registration

A contract that does not mention probation is treated as concluded without one (Article 51.3). A verbal understanding or an internal order is not enough: the clause must appear in the contract itself with a specific length (for example, "three months"). The Code ties probation to the conclusion of the contract, so trying to add it after the employee has started work is a risky step.

Concluding, amending and terminating an employment contract take legal effect only once the notification submitted to the electronic information system with an enhanced e-signature has been registered (Article 49.1); the employer is informed of registration within one business day at the latest (Article 49.2). In practice, make sure the terms in the notification match the signed contract. For details on the notification, deadlines and fines, see employment contract registration in Azerbaijan: e-notification and penalties.

Law No. 332-VIQD of 30 December 2025 repealed Article 53.3. Previously, the contract had to state separately that the employer may terminate it if the employee fails probation. That formal requirement is gone, but since the employer's decision must be justified, it is still worth recording the probation criteria (job description, expected results) in the contract or an annex.

Pay, rights and days that do not count

An employee on probation is a full employee: the contract is in force, and the rules on working time, rest, health and safety and social insurance apply in full. The Code does not provide for a separate, lower probation wage. Pay is due as stated in the contract and cannot be below the statutory minimum monthly wage. Probation counts towards the working year, so it also counts for leave entitlement (see annual leave in Azerbaijan: duration, holiday pay and compensation).

Under Article 51.2, probation consists of the working time during which the employee actually performs the job:

PeriodCounts towards probation?
Days actually workedYes
Temporary incapacity for work (sick leave)No
Excused absence with job and average pay retained (e.g. cases under Article 179)No

For example, if an employee on a three-month probation is ill for 10 days, probation ends roughly 10 working days later. A miscalculated end date can later lead to an argument that the employee had already passed probation.

Ending the contract during or at the end of probation

Until probation ends, either party may terminate the contract by giving the other three days' written notice (Article 53.1). If neither party has demanded termination by the end of the period, the employee is deemed to have passed probation, and from then on the contract can only be terminated on the general grounds set out in the Code (Article 53.2).

IssueEmployer-initiatedEmployee-initiated
GroundEmployee did not prove suitable during probation (Article 70(d); Article 53.4)Own decision during probation (Article 53.1)
Notice3 days, in writing3 days, in writing (normally one calendar month, Article 69.1)

Severance payNot due (only under Article 70(a) and (b), Article 77.3)Not due
Unused annual leavePaid out in cash (Article 144.2)

The key requirements for employers are:

  • Act within the period: the 2026 amendment added the words "within that period" to Article 53.4. Once probation has ended, this ground can no longer be used.
  • Justify the decision: the employer must justify why termination is necessary (Article 71.3). Keep evidence such as assigned tasks, evaluations and written feedback.
  • One ground only: termination is recorded on a single ground (Article 76).
  • Protected periods: an employee who is on sick leave, on annual leave or on a business trip cannot be dismissed on Article 70 grounds, including failed probation (Article 79). Since 2026 the exceptions to this ban are Article 70(a) and (e) only; point (d) is not among them.
  • E-notification: termination also takes effect only after the notification is registered (Article 49.1).

Termination after failed probation is not a redundancy: the notice periods of two weeks or more and the severance pay under Article 77 apply only to redundancy and liquidation. For other grounds, see termination of employment in Azerbaijan: grounds, notice and severance.

Common mistakes and checklists

The most frequent mistakes are: not writing probation into the contract; a three-month probation in a contract of under six months; applying probation to someone listed in Article 52; ignoring sick days; issuing a "failed probation" order after the period has ended; terminating during sick leave; a vague order with no supporting evidence; and filing the termination notification late.

For employers:

  1. Check the cap against the contract length: no probation up to two months, two weeks up to six months, three months otherwise.
  2. Confirm the employee does not fall into any Article 52 category.
  3. Write the probation period and criteria into the contract and register the notification before work starts.
  4. Calculate the end date excluding sick leave and other excused absences.
  5. If the outcome is negative, give written notice at least three days before the end date, issue a reasoned order and file the termination notification.
  6. Pay out unused annual leave in the final settlement.

For employees:

  1. Check that the contract states the probation period and your salary.
  2. Check on the e-gov.az portal that your contract is registered.
  3. Keep records of sick leave and other excused absences.
  4. If you want to leave, submit a written notice three days in advance, before probation ends.
  5. If the order is unreasoned or you were dismissed during a protected period, seek legal advice.

Frequently asked questions

Can probation be longer than three months?
No. The general cap is three months, and for contracts of up to six months it is two weeks (Article 51.1). Contracts of up to two months cannot include probation at all (Article 52).

Do my sick days count towards probation?
No. Temporary incapacity and excused absences during which the job and average pay are kept are excluded, so probation is extended accordingly (Article 51.2).

Is severance pay due to an employee who fails probation?
No. Severance is paid only on liquidation and redundancy (Article 77.3). Unused annual leave, however, is paid out whatever the ground for termination (Article 144.2).

Do I have to work a month's notice if I resign during probation?
No. Three days' written notice before probation ends is enough (Article 53.1). Once you have passed probation, the general rule of one calendar month's notice applies (Article 69.1).

Probation has ended and my employer said nothing. What now?
You are deemed to have passed probation. From then on, the contract can only be terminated on the Code's general grounds (Article 53.2).

Can pay be lower during probation?
The Code does not set a separate, lower probation wage. Pay is due as stated in the contract and cannot fall below the minimum monthly wage. If a different amount has been agreed for the probation period, it should be stated clearly in both the contract and the notification.
