Permanent Residence Permit in Azerbaijan: Eligibility, Documents, Fees and Timelines
26 Oct 2026 Sənan Süleymanlı

Short answer: A permanent residence permit in Azerbaijan is, as a rule, granted to foreigners who have lived in the country continuously for the last 2 years on a temporary residence permit issued under Articles 45.1.1–45.1.7 of the Migration Code and who meet one of the grounds in Article 52.1 (an Azerbaijani-citizen close relative, a total investment of at least AZN 500,000, property, a deposit or securities worth at least AZN 200,000, and others). The permit is issued for 5 years and can be renewed for 5 years at a time with no limit on renewals (Article 54.12). For adults the state duty is AZN 300–450 depending on the processing period. A permanent resident may work without a work permit (Article 64.0.1).

Who is eligible

Temporary residence comes first. Under Article 52.1 of the Code (as worded by Law No. 853-VIQD of 4 April 2023), foreigners and stateless persons who have lived in Azerbaijan continuously for the last 2 years on a permit issued under Articles 45.1.1–45.1.7 are granted permanent residence where:

  • their father, mother, spouse, child, sister or brother is an Azerbaijani citizen (Article 52.1.1);
  • their total investment in the economy is at least AZN 500,000 (Article 52.1.2);
  • they own real estate in Azerbaijan worth at least AZN 200,000, hold a fixed-term deposit of at least AZN 200,000 in a local bank, or hold government securities (or investment securities of majority state-owned companies) with a nominal value of at least AZN 200,000 (Articles 52.1.3–52.1.5);
  • they are a highly qualified specialist (Articles 52.1.6–52.1.7);
  • they are a family member of a foreigner who permanently resides in Azerbaijan (Article 52.1.8);
  • they head a branch or representative office of a foreign company, head or own at least 51% of a local company with a foreign founder, or carry on business in Azerbaijan; in the last two cases turnover must reach the level set by the competent authority (Articles 52.1.9–52.1.11).

Note: people who hold a temporary permit only as family members of foreigners residing on work-permit, study, religious or treaty grounds (Articles 45.1.8–45.1.11) cannot use this route. A foreigner living on a work permit must personally meet one of the Article 52.1 grounds as well. Temporary residence counts as continuous if the person did not spend more than 90 days outside Azerbaijan within any 180 days (Article 52, Note).   2. copy of the passport or other travel document (with the original);
  3. family composition certificate and a notarised copy of the marriage certificate (if applicable);

  13. proof of payment of the state duty — submitted when the card is handed over (Article 53.2).

Fingerprints are taken from applicants aged 15 and over (Article 53.3).

How to apply, processing time and state duty

Applications are filed with the State Migration Service in person or through a legal representative (Article 54.2); the form and documents may also be submitted electronically (Article 54.4). The service is also available at ASAN service centres. The key deadline: apply at least 3 months before your temporary permit expires (Article 54.1). Renewals are likewise filed at least 3 months before the permanent permit expires, with the Article 53 documents submitted again (Article 54.12).

The decision is made within the period that corresponds to the state duty paid (Article 54.9). Under Articles 14.8.4 and 14.8.5 of the Law on State Duty:

Processing periodAdultMinor
35 daysAZN 450AZN 300
40 daysAZN 400AZN 250
50 daysAZN 350AZN 200
60 daysAZN 300AZN 150

The duty is paid when the card is issued: if it is not paid within 30 days after the last day of the chosen period, the permit is cancelled (Article 53.2).

Grounds for refusal and cancellation

Under Article 55, a permit is refused or not renewed, and an existing permit is cancelled, in cases including:

  • a possible threat to national security or public order;
  • a missing document, forged documents or false information;
  • an unspent conviction for an intentional serious or especially serious crime;
  • lack of funds for minimum needs, or failure to file alternative proof within 10 working days after a sponsor withdraws support;
  • absences from Azerbaijan exceeding 180 days in total in any one year (not applicable to permits obtained under Articles 45.1.2 and 45.1.7);
  • the ground for the permit ceasing to exist with no other Article 52.1 ground available (for example, a deposit falling below AZN 200,000);
  • lack of knowledge of the state language and of statutory rights and duties;
  • an expulsion decision, or an unpaid administrative fine for breaching migration rules.

If the reason for a refusal is removed, you may reapply within one month by filing only the document proving this (Article 54.11). If it cannot be removed, you may apply within the same period to extend your temporary permit (Article 54.11-1). Refusal and cancellation decisions can be challenged administratively or in court (Article 56).

What rights the permit gives

  • Work without a work permit: permanent residents do not need a work permit (Article 64.0.1).
  • Visa-free travel: during its validity the card allows the holder to leave and return without a visa, and it proves identity and residence registration (Article 52.4).
  • Family members: family members of a permanent resident can apply for temporary residence (Article 45.1.5) and later for permanent residence (Article 52.1.8).

Frequently asked questions

Can I get permanent residence straight away on arrival?
No. The law first requires 2 years of continuous temporary residence on the grounds in Articles 45.1.1–45.1.7 (Article 52.1).

Are 2 years on a work permit enough?
Living on a work-permit basis (Article 45.1.8) alone is not enough; you also need one of the Article 52.1 grounds (for example, highly qualified specialist status, a citizen close relative or investment). It is worth assessing your case in advance.

How long is the permit valid?
5 years. It can be renewed for another 5 years on an application filed at least 3 months before expiry, with no limit on renewals (Article 54.12).

How much is the state duty?
For adults, from AZN 300 for 60-day processing to AZN 450 for 35-day processing; for minors, AZN 150–300.

Will I lose the permit if I spend a long time abroad?
Yes, if absences exceed 180 days in total in any one year; this rule does not apply to holders whose permits rest on investment (Article 45.1.2) or business (Article 45.1.7) grounds (Article 55.0.8).
