Licence vs permit — what is the difference
The Law (No. 176-VQ of 15 March 2016) distinguishes two instruments:
- Licence — the right to carry on a regulated type of activity (for example pharmaceuticals, private medical practice, education, certain telecommunications services). The lists are in Annexes 1 and 2; Annex 2 covers activities linked to state security.
- Permit — consent for a specific action or facility within an activity that does not itself need a licence. The list is in Annex 3.
The core principle: licences and permits exist only if the Law provides for them. A demand for an "extra permit" not listed in the Law is unlawful.

Supporting documents (Article 18.2 of the Law): an extract from the state register of legal entities, the tax registration certificate, proof of ownership, use or lease rights over the premises to be used, and documents showing the licence conditions are met.
Can a foreign company hold a licence?
The Law also applies to branches and representative offices of foreign legal entities in Azerbaijan. In practice, licences are issued to an entity registered in Azerbaijan — a local LLC or a branch. Five mistakes businesses make
- Misclassifying the activity. A special licence for the wrong sub-type does not cover what you actually do.
- Applying before the premises are ready. Licence conditions (premises, equipment, staff) must be met when you apply — otherwise it is a ground for refusal.
- Forgetting the lease. Proof of rights over the premises is mandatory; an informal or very short lease causes problems.
- Not documenting "silence is consent". If the deadline passes, the licence is deemed issued — but keep proof of the date your application was registered.
- Not reporting changes. A change of address, name or structure may require the licence to be re-issued.
