Trademark Registration in Azerbaijan: Process, Timeline and Costs

Short answer: Trademarks in Azerbaijan are registered by the Patent and Trademark Examination Centre of the Intellectual Property Agency. The process has three stages — preliminary examination (1 month), substantive examination (6 months) and entry in the register (1 month). In practice the full cycle takes 6–10 months. Registration is valid for 10 years and is renewable.

What a trademark protects — and what it does not

A trademark protects your brand only for the classes of goods and services it is registered for. This is the most commonly misunderstood point: "we registered our brand" does not cover every line of business.

What it does not cover:

• Domain names — registering a domain creates no trademark right, and vice versa.
• Company name — state registration of an LLC does not protect a brand. These are two separate registers.
• Other classes — a registration in class 25 (clothing) gives no rights in class 43 (restaurant services).
• Other countries — protection is territorial; an Azerbaijani registration creates no rights in Türkiye or elsewhere.

Before filing: the clearance search

The most expensive mistake is filing without a search. If an identical or similar mark is already registered in the same classes, the application is refused, the fee paid is not returned, and 6–7 months are lost.

A clearance search must answer two questions: is the mark distinctive (descriptive or generic wording is not registrable), and does a similar earlier right exist.

The registration process: three stages

Once a positive decision is issued, the applicant must pay the state fee within 4 months. If it is not paid, the mark is not registered.

Accelerated examination

The six-month substantive examination can be shortened: for an additional fee of AZN 180, examination is carried out within 1 month.

This matters in practice when a launch date is fixed, or when an investment or franchise transaction requires the registration certificate.

Costs

The state fee payable after a positive decision is currently AZN 45. Separate fees apply to other steps in the process:

Term and renewal

A registered trademark is protected for 10 years. The registration may be renewed on expiry, and renewals may be repeated indefinitely — a properly managed mark is therefore protected without a time limit.

The practical risk is failing to diarise the renewal. Protection does not continue automatically; if the deadline is missed the right is lost and a third party may register the same mark.

Protection abroad

An Azerbaijani registration is effective only within the country. If you plan to export, franchise or enter foreign markets, separate registrations in the target countries — or an international application under the Madrid System — are required.

Sequence matters: an international application needs a national application or registration as its basis, so the local filing comes first.

Five mistakes we see most often

1. Filing without a search. If the mark is refused, the fee is not refunded and months are lost.
2. Choosing a descriptive name. A sign that directly describes the product, or consists of generic words, is not treated as distinctive.
3. Narrowing the classes. Cutting classes to save on fees leaves future expansion unprotected.
4. Treating the company name as brand protection. LLC registration and trademark registration are different regimes.
5. Not tracking the renewal date. Letting the 10-year term lapse means losing the right.

Frequently asked questions

How long does registration take?
6–10 months in practice. Accelerated examination reduces the substantive stage from 6 months to 1.

Should the name and the logo be registered separately?
A word mark and a figurative mark (logo) give different scopes of protection. Which one — or both — you need depends on how the brand is actually used.

Can a foreign company register a trademark in Azerbaijan?
Yes. Representation rules apply to foreign applicants.

What can be done after a refusal?
There is a mechanism to challenge the decision; the outcome depends on whether the refusal is based on absolute grounds (distinctiveness) or relative grounds (an earlier right).
