Work Permit and Temporary Residence Permit in Azerbaijan: A Complete Guide for Employers

Short answer: To legally employ a foreign national in Azerbaijan you need two separate documents — a work permit and a temporary residence permit (TRP). The work permit is applied for by the employer, not the employee. The state fee for a one-year work permit starts at AZN 1,000, and processing takes 10, 15 or 20 business days depending on the track you choose.

What does a foreign employee actually need?

A foreign national or stateless person who wants to carry out paid employment in the Republic of Azerbaijan must hold two documents at the same time:

1. Work permit — confirms the right to work for a specific employer.
2. Temporary residence permit (TRP) — confirms the right to reside in the country lawfully.

These two permits are not interchangeable. You cannot work on a TRP alone, and you cannot reside in the country on a work permit alone. In practice this is where most cases go wrong: the company secures the work permit, delays the TRP, and the employee's lawful stay expires in the meantime.

Note: the Migration Code provides exemptions from the work permit requirement for certain categories. Eligibility for an exemption must be assessed case by case — a wrong assessment exposes the company to administrative liability and the employee to removal from the country.

Who applies for the work permit?

This is the single most common misunderstanding among employers. The application is filed by the hiring party, not by the foreign employee:

• the legal entity employing the foreign national;
• an individual carrying out entrepreneurial activity without forming a legal entity;
• a branch or representative office of a foreign legal entity in Azerbaijan.

The administrative burden and the liability therefore sit with the company. The employee only supplies personal documents.

Before the application is filed, the foreign national must hold a work visa or business visa.

Documents required for a work permit

• application form;
• copy of the foreign national's passport or other travel document;
• notarised copy of the document evidencing their qualification;
• a justification letter explaining why the foreign national needs to be hired;
• for legal entities — notarised copies of the charter and the state registration certificate;
• for individuals — notarised copies of the ID card and the tax registration (TIN) certificate;
• a medical certificate confirming the absence of specified infectious diseases.

In our experience the justification letter is the most frequent cause of rejection. It is not a formality: it must set out the substance of the role, the qualification required, and concrete reasons why the position could not be filled from the local labour market.

Work permit: duration and state fees

A work permit is issued for 3, 6 or 12 months. The fee depends on both the duration and the processing track:

Extensions follow the same rules and the same fee schedule.

Important: the state fee must be paid within 30 days after the end of the applicable processing period. If it is not paid, the permit is revoked and the process starts again from zero.

Since 2024 work permits are issued electronically by the State Migration Service, signed with the qualified electronic signature of an authorised officer.

Grounds for a temporary residence permit

Azerbaijani law provides several independent grounds for a TRP:

• close family relationship with a citizen of the Republic of Azerbaijan;
• investment of at least AZN 500,000 in the national economy;
• real estate worth at least AZN 100,000, or funds held in a bank;
• acting as head of a branch or representative office of a foreign legal entity;
• entrepreneurial activity;
• education (higher, secondary specialised and general education institutions);
• professional religious activity;
• status as a highly qualified specialist.

Where the TRP is sought on the basis of entrepreneurial activity, the foreign national must have employment contracts with at least 5 full-time or 10 part-time employees.

TRP: documents, duration and fees

Core documents: application form, passport copy, medical certificate, a document evidencing accommodation (ownership, lease or occupancy order), two 3.5×4.5 cm photographs, and, where applicable, a notarised consent from a family member.

Reduced rates apply to students (1 year — AZN 40/60; 2 years — AZN 80/120).

As a general rule a TRP is issued for up to 1 year and may be extended by up to 2 years at a time. Where the investment exceeds AZN 500,000, the permit is issued for up to 3 years and extended by up to 3 years at a time.

Five mistakes employers make most often

1. Letting the employee start work before the permit is issued. Signing an employment contract does not replace a work permit.
2. Running the two processes sequentially. The work permit and the TRP must be planned in parallel, otherwise the employee's lawful stay lapses.
3. A weak justification letter. Template wording is the most common reason for refusal.
4. Missing the 30-day fee deadline. The result is revocation and a full restart.
5. Planning renewals too late. An extension must be filed before expiry; a delay makes the employee's status unlawful.
